Additionally, certain rights that you or Sekure Nest Home Services (SNHS) may have in court may not be available in arbitration. These terms and conditions also outline the rights of SNHS, its agents, and employees to contact you via phone calls, text messages, and emails on behalf of SNHS and SNHS’s advertisers.

THIS AGREEMENT

1.1 Acceptance. Please carefully read this Agreement before accessing the Website. In order to use the Website, you must agree to the provisions of this Agreement. By accessing any web page of the Website (other than this Agreement), you indicate that you have read and agree to be bound by the terms and conditions set forth in this Agreement. By signing up for any service offered, you represent and warrant that you are at least eighteen (18) years of age and not a minor in your state of residence. If you are executing this Agreement on behalf of an entity or any other person, you must have been duly authorized to do so by such entity or person. Please note that you are not authorized to use the Website if (a) you are not of legal age or otherwise do not have the legal capacity to form a binding contract with Sekure Nest Home Services, or (b) you are a person barred from using the Website under the laws of the jurisdiction in which you reside or otherwise from which you are attempting to access the Website, or due to prior violations of this Agreement. If you do not agree to be bound by this Agreement, you are not authorized to use the Website. If we ask users to acknowledge this Agreement and adhere to its provisions more than once and in more than one manner, such repeated requests and/or multiple executions of this Agreement are intended for the sake of good practice only and do not invalidate any prior acknowledgements or executions.

1.2 Modification. We reserve the right to modify this Agreement at any time. You agree to review this Agreement periodically to be aware of all such modifications. We will indicate changes to this Agreement by updating the date indicated after “Last Updated” at the beginning of this Agreement. By continuing to use the Website after a modified version of this Agreement has been posted, you agree to be bound by the modified version. If you do not agree to abide by the initial version and each modified version of this Agreement, you are not authorized to use the Website. You can access the current version of this Agreement via the footer of the Website’s homepage.

COMMERCIAL TRANSACTIONS

3.1 Purchases. Certain products or services offered by Sekure Nest Home Services may be available for sale through our website, phone, or other channels. Should you decide to purchase any of these offerings, Sekure Nest Home Services or an authorized third party acting on our behalf may request certain personally identifiable information (“PII”) from you, including your full name, address, telephone number, and credit card details. It is imperative that you provide accurate, complete, and up-to-date PII and other required information. Additionally, you must adhere to the terms and conditions outlined in any additional agreements governing your purchase. You are responsible for all charges incurred through your account or made on your behalf.

3.2 Payment. Your access to any service or product available for purchase via our website, phone, or other means is subject to full payment of the applicable fees (“Fees”). Payment of each portion of the Fees must be made in full at the time of purchase or as specified in writing by Sekure Nest Home Services. Visa, MasterCard, Discover, or American Express credit cards may be used to pay any portion of the Fees.

3.3 Taxes. You are responsible for obtaining any required licenses, permits, and approvals under local, state, or federal law related to your purchase of products and/or services from Sekure Nest Home Services or any authorized representative. Additionally, you must obtain all tax identification numbers and settle all taxes, license fees, and other charges owed to governmental authorities or other entities concerning these products and/or services.

Charges and Carriers

Standard messaging and data rates may apply. Please refer to your wireless carrier’s service agreement or contact them directly to determine your phone’s pricing plan and associated charges for sending and receiving text messages. You acknowledge your responsibility for any incurred charges, including usage, subscription, etc., while using our Service.

Our Service is compatible with major carriers such as AT&T, T-Mobile, Verizon Wireless, Sprint, Boost, Virgin Mobile, U.S. Cellular, Cricket, Alltel, Cincinnati Bell, Cellcom, C-Spire, nTelos, MetroPCS, and other regional carriers. However, please note that the availability of our Service may vary across different wireless carriers. ServicePlus Home Warranty reserves the right to include or exclude any wireless carrier from the Service without prior notice. Neither ServicePlus Home Warranty nor the mobile carriers assume responsibility for any delays, delivery failures, or message errors.

Service Agreement

This Service Contract, also referred to as the “Agreement”, issued by the entity listed for your state on the Coverage Summary page, is herein referred to as “Sekure Nest Home Services”, “we”, “us”, and/or “our”, or “provider”. The property owner covered by this Agreement is herein referred to as “you” and/or “your”, or “contract holder”. Sekure Nest Home Services offers home service contracts, distinct from warranties. We reserve the right to amend this Agreement at any time, and you are considered informed and bound by any such changes. Terms may differ across various states.

The provider’s obligations under this service contract are supported by the provider’s full faith and credit.

Certain items and events are not covered by this Agreement. Please carefully review the Agreement. Coverage encompasses only specific mechanical failures of the items listed as covered on your Agreement Coverage Summary and excludes all other failures and/or items.

Sekure Nest Home Services retains the privilege to provide cash back instead of repair or replacement, calculated based on our actual costs, which may occasionally be lower than retail. If a covered system or appliance is determined to be irreparable or not cost-effective to repair, we may opt to replace it with a system or appliance of similar capacity, ensuring that its price does not exceed the depreciated value of the item being replaced. Installation is not within our purview. The cash settlement will not exceed the depreciated value of the component, system, or appliance being replaced. Should you choose to utilize the cash back funds for repair rather than replacement, the affected system or appliance will no longer be covered by our services. We will only provide cash settlement after all past due Service Call Fees and Plan Fees have been settled.
